CA; owner backed out of signed lease agreement 3 days before I was to move in after receiving security deposit from us 4 days prior. I have already set up all the utilities, purchased the appliances and scheduled the movers. The property manager (rental agent) waited almost 18hrs before calling to tell me that the owner decided to back out of the agreement. Owner backed out due to grounds of credit history that was provided to him by the rental agent prior to signing. We paid an additional security deposit due to the fact the owner was not comfortable with our credit and we all agreed that the additional security deposit in order to satisify the owner's issues with our credit. There is one clause in agreement that states " In the event this agreement is not accepted by the Owner, within 7 days, the total deposit will be refunded." Since the agreement does not state anything about the owner being able to refuse us occupancy due to our credit history, do we have a leg to stand on? The agreement states all kinds rights for the owner if we planned not to pay rent or break a rule as listed in the contract, but nothing about the owner's ability to back out due him changing his mind.
