Landlord billing more than stated in lease

What is the name of your state? Arizona

I payed my rent on the first of the month in the same amount that I have been paying since August. My lease is still current and I received a notice of partial payment and a bill for the rest of the rent as well as late fees that have accrued. I paid my bill on time and in full according to the lease. I have proof of my previous payments in the same amount so I am sure this will be cleared up soon, but is this cause to terminate my lease? I have had several problems with this apartment complex and would like to move but will finish my lease if necessary. A law student told me that if my landlord attempts to bill me for more money stated in the lease, it is illegal and I have every right to break the lease. If this is true where do I find a copy of this law? What section of the landlord/tenants act would it be under? Thank you.

What the heckfire does this mean, Amanda? Did you pay rent late and they billed you for late fees? Or are they billing you for all the rent left on the lease? What does your lease say?



A law student told me that if my landlord attempts to bill me for more money stated in the lease, it is illegal and I have every right to break the lease.

I do not like to believe law students who do not show you the relevant law themselves. So I do not believe you spoke to a law student.

Your post really does not make sense. Please do not take offense but it does not... either I am right ... or It is too early in the morning for me to make any sense of it.


Actually this just sounds like a convoluted way to get out of a lease.

BTW , in What monetary means did you pay your rent ?

See , if you don't have a RENT receipt , the LL may have not received it , " For what eva reason " .

You are trying to Justify breaking the lease without FACTS .

Good, do yoiu have physical proof your rent has been paid on time. ie: rent receipt.

As long as you are paying the full amount of monies owed AS STATED in your lease, you are in good shape...

No... not a valid legal reason to break a lease.

Having problems with a LL is irrelevant if you do not take the proper steps. Read up on AZ's LL/T laws...

partially right: It is illegal to try and collect an amount that is different than what is stated in your lease, but it does not constitute a valid reason to break a lease. There are NO statute relating to residential LL/T laws that allow a person to break a lease for bad billign practices. If that were so, imagine everyone would be able to break their lease becuase management billed them 5 cents more than what the lease states. Tell the student to keep his nose in the books, he needs to read some more...

LOL it must be early there. Sounded to me like management is trying to sneak a rent increase by her during her lease.
