I have nine months left on a 1 year lease on the house I live in. Tonight
I came home and found the landlady waiting. She was there to tell me she is breaking the contract because she sold the house she is living in and needs a place to live. She gave me a "Notice to Terminate Tenancy" with the reason "Landlord sold her property and needs to occupy this home" and she expects me to find a new house and be moved in two weeks. I cannot do it and I do not think I should have to.
Is this legal? Is a landlord not held to the same contract as the tenant? I told her I would let her know on Monday if I intend to fight her or not. I think I should be entitled to some compensation for her breaking the contract. When I rented the place she reiterated several times that if I broke the contract, I would forfeit my deposit. Since she is breaking the contract, I think I am entitled to compensation equal to my deposit. The same penalty for her as for me.
She thinks the very idea that she should be penalized for breaking our contract is outrageous. She says she will pay me back the 8 days of rent between the 20th and the end of the month. She won't give me back my deposit until I am moved. I do not have money for another deposit and rent after only three months. Somehow, in the middle of the month I have to find money for rent and a deposit without getting back what she is holding. This is not fair.
I said I’m not moving unless I get my deposit plus $1000 to cover my moving expenses. That $1000 is less than my deposit. She can just rent a place for herself. Am I entitled to conpensation when the landlord arbitrarily breaks the contract?What is the name of your state (only U.S. law)?
