I rent space for my mobile home in a mobile home park. I have occupied space there for 10+ years with a lease agreement that outlines the rental amount and when it was to be paid. The Owner failed to collect any rent in exchange for services that do not meet the definition of actual employment. Without notice, after 10 years, he terminated the need for those services and is now enforcing the rental portion of the lease agreement. I cannot afford the sudden payment of space rental so I vacated my mobile home in order to prepare it for sale because he will not allow me to rent my mobile home to a 3rd party...saying all tenants must be the owners of the mobile home.
I have received eviction notice to appear in court but need time to either sell the mobile home, move it or be allowed to rent it out. Shouldn't it be considered that since the landlord essentially violated his own lease agreement by not collecting rent, the whole agreement/contract could be void?
