Landlord forcing me to move out on Dec 30!!

My landlord asked us to move out on December 30 because she needs to do some "home repairs" to have the place ready to be occupied on January 1st.

My new place is available on January 1st. I have no place to stay on the 31st, and no place to leave my stuff. My only option is go to a motel for that night (and pay $70) plus make a DOUBLE trip with all my stuff to the motel, and then to the new place (another $60+ or so.)

Is there any way to prevent my landlord from doing this? What can I do?

Also, we are being harassed almost everyday by the landlord. Everytime she sees us, she has this nasty attitude and she keeps asking us "Are you guys packing already??" "You have to be out by the 30st." Almost like if we were overstaying. We paid for the whole freaking month! We're on December 19. They have been asking us whether we packed ever since they found someone to move in. We're sick and tired of having to be pressured to move out more than 20 days in advance.

Any suggestions? Thanks in advance for any help you can provide.

tell your LL in writting the only way you will leave early is if you are paid to do so in cash other wise any attempt to force you to leave sooner than the time you have paid for will result in a lawsuit should any action be taken that can be construed as illegal eviction according to your states laws and plan on being out by the night of the 31 and then camping out in a motel for new years eve . in fact make your reservation NOW . do keep a copy of the letter you send registered mail in another location . if they have a new tenant who wants to move in on january 1 the new tenant can take possession of the unit then . go to your state govt web page links and look for LL/t links to search on your states laws before you send the letter .

You have until midnight the 31st to be out . NO sooner.

Remind your landlord of that ... and tell them to quit harassing you that you have arrangements,and any other arrangements would be inconvenient and costly to you.
Make sure you leave the property empty a swept clean , and in good condition. Take pictures if you can .


Many landlords will allow tenants to move in early IF the apts are vacated early or empty.

Perhaps you could call your new landlord and see if that could be arranged with you.
