Can we break our lease without having to pay extra rent and losing our deposit, for harrassment from the landlord. We have recieved lease violation papers for things not listed on our lease. such as candles can not be burned in the apartment at anytime. The landlord has also yelled at my husband in the courtyard area for using the wrong trash can. He was walking by and place a small bag in the can. The landlord removed the bag and handed it back to him While yelling at him like a child. My husband took the bag and said okay and walked off. What exactly consitutes harassment and is that basis for terminating our lease?

you need to switch all communications with the LL to written letters where you make a copy and send the Letter with a certificate of mailing at the very least . as your LL comments about different things suchas the candles then in letter ask wich paragraph /clause in lease bars use of candles ? With written letters you then have proof of addressing the complaint and helps build a paper trail . the yelling and such isnt in itself enough to break lease , so thats why your going to keep communications in wrtting so that way when your LL trys to declare a breached lease you can counter that your lease either doesnt cover the subject . or it does and how the lease addresses subject . when the LL gets tired enough of the letters then you could offer that you will move when they give you a letter canceling the lease and switching you to month to month . so you can start looking .
