on december 30, 2000, i paid my rent by money order. because of my disability, i sent my 9 year old to the office to pay. about a week later, the landlord sent notices stating that the rent was stolen and that I had to pay the rent again. she instructed me to stop payment on the money order then repay when I recieved the refund. She then said that she never saw the rent. we argued because my children insisted that she took the money. i didn't trust them and did not call for a refund. i had proof that i paid. on february 3rd i moved. the landlord is now saying that my deposit will be withheld until january rent is paid. i asked how she could hold me responsible for a robbery and she said she was within her rights. is this legal?

Come on man.....learn from this.....if she said it was stolen and you didnt put a stop onit...man thats dumb!

So why didnt you do a search on the money order and see if they cashed it?

You have the reciept, the company name who issued the MO, see if its been cashed. it shouldnt take long...

i think american express and western union can verify if its been cashed over this here compooter....

call the 800 number and do a trace on it....

If its not been cashed well ya gotta pay the landlord!

If its been cashed locally you have a criminal case against whoever signed it, and maybe the landlord, if they pocketed it.

I tell tenants to not mail a money order because the PO said they won't start a search for 30 days. But you should be able to verify it was cashed, or get a refund from he PO

If you use a cashiers check -- you can for a big fee cancel it.

If you can prove they accepted the payment, I'd guess it's their problem. Next time get a written receipt --

If you really paid and can prove it -- go to small claims.
