I live in California and my landlord has requested an inspection of the property.I'm concerned that she will try to look for something to evict us for, because last month she said that she didn't recieve the rent, when through a certified mail reciept and tracking # I proved that it was in her pobox 2 days before she said that she didn't get it.
It was immedialty after that that she requested the inspection. We live in San Jose where rents have skyrocketed through the roof and I think that she wants to cash in, which is fine-hey that's what America is about, but I don't want her to cash in at my families expense. Besides obvious garbage and damage to property(which we don't have) what are other things she could try to evict us on?

well do you have a lease??????

If not then she can evict you for NO REASON, 30 day notice and be out by March 1st.

If you dont have a lease, you should be ashamed of yourself for putting your kids in such danger of losing your home.

First of all, as a technical matter, LL does not have a right to enter your apartment for an "inspection". However, she has other ways of characterizing her visit, and you have no reason not to cooperate with her, so you have no reason to antagonize her by trying to deny her the right to enter.

Is San Jose under rent control? If so, that may be a reason why she might want to get rid of you. Its nothing personal, its just that she may be able to raise the rent for someone else more than she can for you.

Wait and see what she comes up with. She must give you a 3-day notice to cure any breach of the lease, so you will have 3 days to fix anything that she complains about.

Since you have already experienced some difficulty with her admitting that she has received items, you might worry about her saying that she gave you a 3-day notice when she didnt. Maybe you could send her a letter saying that you enjoyed her visit, she is welcome to come and inspect any time (with notice, of course) and you want to record that she said that everything was fine.
