california... i have a lease that is up on the 21st of this month..my landlord is selling the property and escrow is to close on the 24th of the month...but it was also gonna close 2 months ago then they said "oh another week or two and finally after my lease is ending..funny huh! during this entire time he has wanted me out!! he promised to buy me out of the lease..but now he says hes getting no $ from the deal..but since my lease is up he doesnt have to, right? well in my lease it calls for a 30day notice at the end of the term lease...does that still apply or do i have to be out in 10days? what should i do...i think this was the realtors plan all along...what should i do? thanks in advance...

Your lease is up in only seven days, so there's no need for him to buy you out of it unless, of course, it says in your lease that it's automatically renewable. You should have been keeping your eyes open for a new place.

You still can't be kicked out, by the old owners or new, without the minimum notice required by your state. Which in CA I think is 30 days.

Okay Escrow Fell Through... I Think?

Well My Landlord Was Still Willing To Give Me Money Since The New Buyer Didn't Want To Wait The 3days For My Lease To Expire And My Landlord Never Gave Me A 30day Notice...long Story Short...he Wasn't Gonna Get Any Money From The Sale Due To The Fact He Refinanced And They Have Pre Penalty Or Something To That Effect, Now The Buyers Lender Backed Out But He Is Still Looking For A Buyer... He Hasnt Paid His Mortgage In 5 Or 6 Months So I Know Whats Coming...it's Kinda Impossible For Me To Just Up And Leave Right Now And He Isn't Being As Honest As I Thought He Was...will I Know When The House Is Being Foreclosed On...will The Bank Post Something On The Front Door..do I Have X Or Should I Prepare Myself For The Worse? Do I Have Any Rights? Do I Still Get Atleast A 30day Notice In This Case ? Thanks For All The Great Advice...i'm Stressed.

It actually sounds as if you have gotten a great deal of information throughout this process.

If no one has given you 30 days notice to terminate your lease, then YOU give the landlord 30 days notice. Find a new place to live and move out. You owe rent for the time you live there. Whether he pays his mortage payment or not has nothing to do with whether you owe rent.

Please do not type in all caps. The forum software turns it into a goofy and equally hard to read every word is capitalized. If you escape that it looks like you are shouting.

Sale doesn't change anything with respect to your rights (which aren't much on a tenant at will). Foreclosure would typically invalidate the lease however.

he's waiting...

I understand that i will ultimately have to move out when the bank takes it but will i get a notice that the house is in foreclosure..do they post a sign outside the house? how do i know when its in foreclosure as opposed to the owner just being in default of the loan? i just dont wanna come home with a padlock on my door.
i know i have to pay rent no matter what and i have been doing that i just dont think the lalndlord is gonna tell me how long i actually have before the bank just takes it. im looking for a place but until then i have to stay here. will i kno before i have to leave?

Well can u believe it the real estate agent came to my door on wednesday befor the the 4th of sept. to tell me that the sale was back on and the loan papers would be signed by friday and the house would be sold by Monday!!! What!!!! I dont understand ...my landlord still hasn't said anything to me... he accepted my rent for the the month of Sept. and now he just wants me to move...do i have to go. He hasnt said anything but he never does, its always the agent giving me these messages.Its almost harrassing now..what sshould i do? I want to just move and be done with this situation but my finances wont allow it right now...what options do i have if any? donn't i still need a 30day notice in writing? help me pls... thanks so much
