I don't seem to have the receipt for the $1500, but my thoughts were to take him to small claims court, and make him produce the paper I signed. I took an advance on my salary, so my work knows I paid it. But this scum-bag took my things, and wants $2600. How can I get back my money he has garnished from my wages, and it is still going on. This is the 4th pay-check he has taken $320.00. Thanks for your help.

It doesnt work that way.....

If you take him to court, YOU have to prove he owes you $1500, he can just stand there and say your honor he has NO RECIEPTS!

Case DISMISSED!

Next time you wont be such a scatterbrained little boy and you will KEEP all your leases, ALL your reciepts, and pay NOTHING in cash!

This will be a very expensive lesson in LIFE SKILLS!

Landlord is garnishing my wages

I can get proof from my work, that I had an advance on my salary for the $1500; but the landlord is garnishing my wages. I guess my next step, is to go the small claims court, and explain the situation to the judge. The landlord changed the lock, stole my things, kept my security deposit, and after paying him $1500, he is still garnishing my wages for $2600. I'm not a little boy and I resent the verbal abuse. Excuse me but I happen to be 49 yrs. of age, and a college grad. I didn't expect this to go any further, and I talked it over with my fiance and she agreed we would just let the $1500 go, until this happened. Now we're mad, and we want something for this. Please help, without being sarcastic. Thank you.

Well get the proof of the $1500, and take as much documentation as you can get, any witneses to show up with you, demand all proof from the landlord of actual PAID damages with the cancelled checks...

counter sue for conversion of property, prove he had a process server try and locate you, and demand the process server be in court.

The judge will ask if you want a continuance say YES...in order to supeona the process server and the landlords records.

Sorry buddy, when you left you didnt call the police, and didnt tie up the loose ends....

And you are dealing with a low life Communist Redneck hell bent on destroying our great country!

Thanks for the help. I did go to the police, and also to the post office, because the landlord held my mail, and also mail of other tentants. My boss will write a statement of the $1500 advance, and I did file a stolen property form with the police. I plan on going to the court house and filling in the form to have him go to Small Claims Court. I know now, I should have gone to the police, when my locks were changed. I've always paid my bills by check or cash, but since the landlord insisted on my paying in 3 days, I felt cash was best. He is a real estate agent, so therefore had a lawyer available to him. I did take pictures when I was able to get in my apt. to remove my belongs. Thank you for your reply.
