landlord keeping deposit...no reason

What is the name of your state? california
i've been in my apt. for 2 years, and am currently on month to month. after giving 30 day notice to move out, landlord said she did not have the money to return for my deposit...spent it. wants me to stay in the apt. until i have "used it up." also, gave me last month free. (still owes me 600) however, i do not have a copy of the lease. i signed the lease through an agent, whom she no longer uses. still have contact with him, and he acknowledges that she owes me the money. he also says that she has the lease. she won't tell me. do i have any rights here even though i don't have the paper copy? please help.

you can get screwed very easily by being so scatterbrained.

I guess you will learn from this lesson.


The only way out of this is to quickly get the landlord and YOU to sign a statemnt that you will be usingall the rest of your security depsoit of $600 for junes rent and you will vacate by june 30th. and by signing this statement the lease terms have been fulfilled by both parties.

Other then that how can you prove anything?

thanks for the reply...certainly scatterbrained...i appreciate you pointing out the obvious...my question should be...because i paid another person the deposit, and he has paperwork to prove that i went through him, can his verbal testimony support me in getting the money, or is it even worth it?

does the agent have any proof (check)that he gave the security deposit to your landlady?

Why not just stay and use up the security?

PS......look how easy this would be for her to start eviction proceedings tomorrow, because you havent paid the rent for 2 months!!!!

I hope you NEVER lose your lease again, and NEVER give the landlord any money for a new apartment, untill you have signed lease.

If the landlord refuses to give you a copy of the lease, offer to drive them to the nearest 7-11 and make copies, if they still refuse, THEN RIP UP YOUR CHECK and leave.

I would NEVER rent anywhere without a first years lease, that is to protect me against a low life alcoholic drug addicted peeping tom, REDNECK pervert....Then after a year..If the landlord is a good boy or girl then its ok to go month to motnh.
