Landlord keeping deposit with no reason why

My landlord is refusing to give me back my deposit of $1100. We did give notice to vacate properly. He did acknowledge my letter stating we were moving. The landlord lives in Somerset, MA and the property I rented is in Florida. We have been moved out since August 1st, 2009. We did not do a final walk thru b/c he said his daughter was unavail so therefore to leave the keys on the counter and we should be fine.

On August 18th I called to find out why my deposit had not been returned as of yet, and he said he hasn't had a chance to have his daughter go over and look at the property that it would be sometime that week.

September 3rd, I sent him a certified letter stating that according to Florida Statute Section 83.49, F.S. and Section 83.49, 3 (b) (c), F.S. he had past his 30 time for letting me know why he was keeping my deposit and if he planned on imposing a claim.

On September 8th he received the letter and called me. He left me a vmail saying the reason he hadn't gotten back to me was b/c he was still waiting on someone to go clean the rugs?

I called him back and advised that at this point he has no right to keep my deposit since its been past 30 days and I have YET to receive any type of notificiation as to any claim being imposed on my deposit.

His answer-take me to small claims court, now supposedly he's saying the house was left a mess and I had people living there that weren't suppose to be. This is not true and when I asked who told him such thing he said oh someone told my daughter.

So do I have a claim for small claims court? :confused:

Check FL small claims court on how to sue/serve in MA....for $1100 - you may be best advised to have a private process server serve the court documents on your ex/..

Security Deposit not refunded

This is Creepy! I also lived in Fl, Orlando area and Am awaiting my $1100 security deposit. I also moved out on Aug 1st 2009. My landlord disconnected his phone, is ignoring me and keeps on making excuses. I hired a lawyer to write him a letter stating that it's 53 days and he lost all rights to the deposit and needs to send it to me. While I left the apartment perfect! I paid $230 to have it professionally cleaned and the carpets steam cleaned!
