My sister lives in New Mexico. She is renting an apartment from a single owner. Her neighbors are unhappy that she has two small children and have complained about noise (She lives in upstairs unit). The landlord gave her a seven day notice to vacate. She found another apartment and applied for it. Her current landlord told the new prospective landlord about the seven day notice. Is this Legal? She has always paid her rent on time. I thought the landlord could only reveal the move in and expected move out date and whether the resident had paid their rent on time? Please help. She has got to move soon.

It is legal for the landlord to provide a prospective landlord with a tenant reference to include the tenant's rental paying history, compliance/noncompliance with house rules and terms and conditions of the lease agreement and reasons that the tenant is vacating. The current landlord can not discriminate or say things that are not true. In this case the current landlord was truthful and just reported the facts. The reason for the 7 day notice was not because the tenant has 2 children but the noise that the children make violating the terms of your sister's lease agreement and which apparently has interfered with the quiet enjoyment of the other tenants.
