landlord refuses to fix problems

good morning
as many of you are aware of my situation, hubby is currently deployed in the iraqi theater of operations with the united states military, we have a court date june 2, 2003, however he petitioned the court to stay the proceeding until he is able to appear and participate.
the upper darby health department has informed landlord that small repairs are needed in the house, however it has been a month and the conditions are still here.
Can the health department evict us knowing that hubby is deployed and can the landlord be held responsible for causing stress, she is aware that hubby is deployed and in the sailors and soliders act of 1940 anyone causing eviction or stress is liable in the court of law?
please help
she is still trying to sell the house
