I recently sold my house on a land contract. The new owners have one year to fix up the house. I have a current tenant in the house, whose written lease expired in November of 1999. She was given 90 days notice to vacate the property, she has not paid any rent since she was given notice. The new owners want to move in on July 1. What rights do they have? And how can we get current tenant out? I live in Florida. Thank You for any help you can give us.

Who is the owner of the house right now? Have you closed? Is moving the tenant out a condition of closing? Why is this your problem instead of theirs?

Whoever is the owner will have to evict the tenant for nonpayment of rent. Talk to the local landlord tenant association or buy an eviction kit (forms & instructions for FL) from an office supply store or legal services company. If they own the house now, you will have to sue tenant in small claims court for back rent.
