I live in TN in an old bank the upstairs has be converted into a one bedroom apartment. last night when i got home the landlords son had kicked the lock out of the downstairs door to cut the power and water off he tried to get in upstairs but i had the door knob tied where he could not get in I have lived there for three months there is no lease the rent is 1 week and 2 days late only because the bank has not sent me my new checks and i have explained that to the landlord. he left a note on the door saying if anyone enters this building they will be arrested. there has not been any kind of eviction notice or anything like that. I am moving out Saturday and they said the are going to have the place locked up so i can't get my furniture is there anything I can do about this can they legally come in to turn power off or do they have to go through electric company? Oh son has been convicted several times for breaking and entering and theft.

I have lived there for three months and already the rent is 1 week and 2 days late.

The reason that the rent is late is not important.

The landlord is probably not allowed to handle a late rent problem in this way, so you should check TN law.

Are you planning to pay your bill before you leave?

I plan to pay it this afternoon all i am late is $50.00 can they lock me out because of this and hold my stuff

Late is late.

As for locking you out because of this and holding your stuff, check TN law. Then after you read the law, think of what can you do about it?

I would think that, after you pay your bill and leave, the landlord would have no more reason to want to hold your stuff.

Before you leave make sure you have proof that he turned off the power... take pictures of the electric box broken into or take a video camera and video tape the apartment with all your belongings just in case he keeps your stuff... you will then have proof that you had lets say an antique rug worth $2,000.00 etc.... This will also help you if he comes after you for damages to the apt. Also if the electric is in your name he has NO RIGHT to shut it off!!! Call the electric co. and tell them what happened. Also He cannot keep your stuff worth $1,000.00 for a $50.00 rent payment. Your best bet is to move out, pay him what you owe, and if he keeps your stuff call the cops and go over there and get it, maybe even put him in jail for theft. If you can't get your stuff through the cops take him to court. Make sure you keep good records of the dates and times you speak with the lanlord or son and what the conversation was about and all your returned checks for rent...your lease agreement etc.. you will need this to back up your story.

The landlord cannot evr no way PERIOD evr lock you out cut off utilities NOTHING without a court order...
