state of florida: landord wants to sell property while tenant is living in premises. tenants are not cooperating with landord to sell the premises, can the tenant withhold landlord from selling his/her property? does the tenants have to cooperate with landlord to sell the premises?

A1) 'Withold' in what way??? Can he refuse to schedule access to show the property?? Of course. Can he refuse to keep the property 'sale spic-n-span'?? Of course.

Q2) "does the tenants have to cooperate with landlord to sell the premises?"
A2) Not unless there is an obligation to do so in the lease.

Are your the landlord wanting to sell?? If so, you might talk with the tenant and see if you can negotiate some resolution to allow your selling the property. This could include providing maid service or reduced rent or an inducement to terminate the lease early, etc.

If the lease allows the landlord / tenant to terminate with 30 to 60 days notice perhaps then the unit should be empty and then there will be chance to go in do what ever needs to be done and show it while on market as empty . Rather than while occupied .

The question is... Do they have a lease?

If they do they have the legal right to stay until the last day of the lease. As long as they pay the rent and you cannot refuse the rent.

If you want them out you will have to pay them to move.

If they have No lease then give them 30 days to move out and then it will be empty on June 1st so you can start preparing for a the Big open house on June 4th and 5th!
