I live in San Diego, California
On Dec 17,2000 I received a 30 day notice of rent increase.
On Jan 11,2001 I received a 5% late charge notice on the new amount and a 3 day pay or quit notice for the
new amount.
30 day hasn't even past yet ?

DO you have a valid lease, then they cannot raise the rent till it expires.....PERIOD!

If you are a month to month tenant.....then YOU have your proof right there.....Make a copy send it certified mail return reciept...

Fax a copy too..saying that the 30 days has not past and it is a clerical error on their part....

Also when do you normally pay rent.......?

Here in New York You would NOT be obligated to pay the new rent until Feb 1st, if you pay your rent normally on the 1st.

You are entitled to 30 days notice, unless the raise in rent in 10% or more. A new law in California, effective January 1, 2001 requires 60 days notice for riae of 10% or more.

Send a letter (certified, thus getting it dated) enclosing copy of 3-day notice.

It's probably a mistake.
