I am currently purchasing a small peice of property in Oklahoma. I wrote the contract, which the owners agreed with and we signed before a Notary Public.
The contract is short, and says that we(the purchasers) agree to pay no more than $300 per month until the balance of $7000 is paid. Payments due by the 10th of each month.
Of course there is a little more than that on where the land is, and what all is on the land. But there is no mention on what happens if we pay late. We have given them twenty dollars this month, but have not been able to make the full payment. We have every intention to pay, however we are late.

Now, the owner has been renting and is being kicked out of their rental, and since we are late on paying our rent, which doesn't happen regularly, they tell us we broke the contract and have to move out so they can move in by the first. I have requested a written eviction, which they have not given to me yet. Can they just kick me out? And after they give me the eviction, how many days do I have? Nothing in the contract says I cannot reassign the contract. Can I assign it to someone without their approval? If someone wanted to take over payments or something?

You should NEVER be late with your rent.

The contract is betweeen the two of you and no one else...PERIOD!! It must be stated if you can assign or have someone else take over the purchase since there is Nothing...then YOU are stuck with it.

The owner must evict in court.....After all tell him this is America and not some backwoods 3rd world Redneck country like Afghanistan.

And for his being kicked out of his rental is of no concern to you.

Now you will learn from this experience, If you cant Borrow the money from a Bank THEN YOU CANT AFFORD IT!!!!!

So Do yourself a favor, move out and rip up the contract, because IT WILL GET UGLY! ...after all you live in Okiehomie and with Rednecks!
