I OWN A 2 FAMILY HOME WHICH 1 APARTMENT IS OCCUPIED BY A TENANT AND THE OTHER I LIVE IN AND I WANT TO EVICT THEM BECAUSE MY DAUGHTER WANTS TO MOVE UPSTAIRS FROM ME AND I HAD TOLD HER TO MOVE OUT WITH IN REASONABLE TIME
AND 2 MONTHS HAD PASS BY AND SHE IS STILL LIVING HERE MY DAUGTHER IS MARRIED AND PREGNANT AND SHE HAS TO TAKE CARE OF ME BECAUSE I HAVE HEART PROBLEMS PLEASE HELP!!

My response:

She doesn't have to move until she is served with proper, legal, notice. Assuming the tenant is only on a month-to-month lease, all you need do is serve her with a 30 day Notice to Vacate. Then, of course, the fun begins when she fails to move. Then you have to sue her for Unlawful Detainer. That could take anywhere from another 60 to 120 days to complete.
