my wife and i are on a 72 hour notice partly on our own doings with a roomate situation which has constantly spiraled out of control in lakewood colorado our landlord/roomate has done little or nothing to accomodate my wifes visibly obvious disability and disregarded my own mental disibility issues on many and continually progressive means. my wife is 3'7" tall and wheelchair bound 75 to 90 percent of the time, (her disability is Larsen's syndrome and aeortic heart valve replacement) and tho the landlord did give me materials to assist in building ramps, the materials were inadequate and not well maintained prior to the building of the ramp so they are currently fallingapart in the weather. one ramp was decently provided as a upper level i placed on a previously built ramp we brought. Since the winter weather and recent report we need to re-replace her valve and the constant disrespectful actions of not running heat when its -5 degrees farenheit outside as well as not allowing us to utilize the shower even bidaily as we have done as of late to cut down chaos. The biggest issue we have found is my wife cannot reach or safely maneuver to do chores in the house and the landlord who fully is aware she cant do it demands she does. we refused to pay him our rent this month because we are seeking another apartment and would not be able to pay rent/deposit if we did pay him and work on that. we are pending a 72 hour notice effective today and working on housing options veraciously with little or no avail for our income level and previous evictions any advice in this would be greatly appreciated and thank you so much.

You did not contact the housing authority or code enforcement prior to withholding rent. That was improper. You need to pay the rent now, and contact the proper government agency on monday to file complaints about the accessibility of the property.

Maybe what you ought to do is research your rights under ADA. Your landlord has to provide reasonable accommodation. That means he can give permission for you to make certain changes of the house. It does not mean that he has to pay for it. It also means that you have to restore the house to it's original condition when you leave. If you want to help your family pay your rent and get your wife a stool or something to stand on. you have a valid complaint about the heat but that is it.

Did you all catch these words from OP,"previous evictions"? They use their disability to get our paying rent or a lease. The LL did provide material, your disabilities are your problems not the LL. Just because you are seeking another apartment is through no fault of the LL, you chose to look for another place. Why should the LL be out of money? You need to pay your rent and stop getting evicted using your disabilities for a pity scene. We all have some type of disability but we pay our rent.
