I am confused by your response in regards to early termination of my lease due to excessive burglary at my apartment. You state under Florida statute 83.56 I have a right to do so, is the neglegence of the landlord related to not enough security? Let me be more specific as to my plite. My first occurance was while at home my window was broken to gain entry I called 911 while hiding in my bathroom and a report was made. Secound time my door was kicked in while at work again a report was made in the meantime I lost personal items as well as money.This seems to be an ongiong problem within the complex as stated by other residences and I was not made aware of this problem prior to leasing. Please advise if my recorse is related to not being warned of numerous buglaries? Also am I liable for the damages to the window being broke and the door jam being kicked in and am I entitled to any return of funds for deposite and prepaid rent for this reason under early termination?

I am not responding for IAAL. Here are my comments. In general, the landlord was negligent as follows 1) by not disclosing the crime problems with the neighborhood and your complex upon your application to rent and at the time of your leasing 2) by not providing additional security measures to protect the tenants. Your valid reasons for early termination of your lease is as stated above. In light of what has occured you should immediately notify your landlord in writing and move to a safer neighborhood.
You will be charged rent for the time you lived there but should not be charged once you leave provided that the required and proper notice is given. You are entitled to a refund of prepaid rent and return of your full security deposit under the terms of your lease agreement. You are not responsible for the damages that occured. Your landlord and/or his insurance must take care of the repairs.

Make sure L replaces the door jamb with a stronger one, rather than just replacing/repairing the door. You tenants should also demand security lights with motion detectors.
