my home is in west virginia and we rented to some people about 5 months ago, they signed a 1 year lease, well we get phone calls from freinds about how my yard is getting trashed and their are 4 couches setting outside against the house they are trashing my home , we have decided to move back and we want them out while we still have a place to go ,please can someone give us some legal advise on how to approach this !!!!

You have to verify everything, go to the house and do an inspection, take a video camera, AND some disposable camera to document everything ....then you have to give them say 10 days to cure the breech of the lease, if they dont then you can start eviction proceedings in court.

The tenant has the right to stay there the FULL year, if they comply with your clean up order. Thats why YOU have a lease it protects BOTH tenants and landlords,from ARBITRARY dumb decisions like you are proposing....

Other then that the easiest way to get them out is to ask them to leave and YOU WONT SUE THEM FOR DAMAGES, and if they are smart they will leave.

I'm not sure what the laws are like in your area, but you should look into the "30-day notice to quit" and "waste laws" which refer to the abuse of the tenants on the property. The landlord always has the right to end the lease, as does the tenant usually with a 30 day notice. You will end up in housing court if the laws are anything like Massachusetts, but it's your property...stand up and make your voice heard. What we need is laws which allow the landlord control over what he has worked so hard to have. Another option: give the tenant back the security deposit and give him/her the rest of the month to move- no strings attached. My lawyer recommends trying that to avoid court and a bad judgement.
