my daughter rented an aprartment in Cleves Ohio on a month to month base without any contract. Her payment was received by the landlord late for the last two months and told her he wants $70 dollars for a late fee. He said he gets 20 percent of what the rental fee is ($350 per month) when the rent fee is not on time.

My dauther swears she has been sending the mail out on time and thinks that the mail is not running on schedule since the 9 11 incident.

Is she obligated to send the landlord the $70 dollars?

Any information would be appreciated.

Check the lease, is there anything regarding late fees? If so she is required to pay the late fees. Although 20% does seem a bit high. You may want to check local landlord tenant codes to see if there is a limit on late fees. In my state the llimit is 5% of the rental amount.

Thank you for your reply. But the landlord never gave my daughter a lease because she was just going to stay for a few months. It dosen't sound like good business practice to me.

NO signed lease NO late fees..its that simple.

A landlord can only collect what they signed for.

Also with NO LEASE your daughter has only ONE right to that apartment:

And that either her or the landlord must give a 30 day notice to vacate. Which starts on the day the next month's rent is due.

Thank you for your information. I told my daughter and she felt glad but her husband thinks if he don't send in the late fee the landlord is demanding that he will be forced to leave.

and what if they send in the late fees and still get evcited?

with NO LEASE...they might as well move,give thier 30 day notice to be out by Nov 30th, because who knowns what the landlord will try and scam them out of next.

OH ITS The seucrity deposit, the landlord has spent the money so your daughter will have to sue the landlord in small claims court for the deposit back.
