i live in a trailer park in sissonville, wv. we own the trailer, we only rent the space. we are two months behind on rent, and received an eviction notice. so, we borrowed some money in order to move the trailer to a friend's property. yesterday, while my husband and his buddies were taking the porch and a/c unit off the trailer, the landlord stopped by. first, being sarcastic, he said, "thanks for the notice" then a few minutes later he came back and told my husband that we can't move until he gets his backrent. first he tells us we have to leave and now he's saying we can't! can he do that? we have no problem with paying him what we owe, we just can't afford it right now. what should we do?

I don't know anything about either WVa or mobile home law, but if the landlord is entitled to a lien on the mobile home for the past due rent, then he can stop you from removing the property. That's his collateral for what you owe him.

Check the eviction order. Does it order YOU to leave or does it order YOU and the mobile home to vacate the space.

You should find a way to settle this dispute with the landlord so that you can both get on with your lives. Borrow the money, or offer the landlord some other kind of collateral to assure him that he will be paid.
