What is the name of your state (only U.S. law)? Illinois

I am a landlord and my tenant is late in rent payment. In the "To" part of 5 day notice, I filled in the name of the lessee (tenanant) only and did not mention anything about other occupants.

I live in Bolingbrook and the city has rental occupancy permit where the tenant's name and occupants are mentioned.

My question is, since I did not mention other occupants in the notice. Assuming this thing did go through eviction would the sherif evict all the occupants even though their names or the word "other occupants" was not in the notice.

Any assistance would be helpful.

A court order (the eviction notice) only applies to those named on it. You will have to add all the occupants names to evict everyone.

racer72,

Thanks for your input, so I gather I have to send a new 5 day notice with the tenant names and word "all other occupants" added on ... corect.

"All other occupants" because I don't know who else may be living above and beyond the names mentioned in the rental occupancy permit.

Thanks.
