What is the name of your state? NY

What is the landlords legal resposiablity to their tenant after a fire destroys the entire property and all of the tenants belongings? Is tenant entitled to some sort of compensation from landlords homeowners insurance?

Also,

Is tenant responsiable for the entire months rent if the apartment burnt down and she is obviously homeless for half of that month?

Thank You,
Sam K.

Not usually , that's what renters ins. is for .

Unless the fire was caused the negligence of the LL and you can prove it ( FD report ) .

Was the fire your or your guest fault from your Apt . ?

What is the normal / requested way you paid the rent ?

If the fire was not caused by / from your Apt . , or by you or your guest , yes rent should be pro-rated .

If the fire was near by only a few days from your rent due date and not caused by you nor guest , the LL should be chalking it up , but doesn't have to .

You do not say when your rent due date is and how late it would have been .
