What is the name of your state? Florida There is a small, unfinished apartment attached to the home we rent. When we leased the house and property, it was with the understanding that the landlord would occasionally use the apartment for a break during the day or to stay a night if he were too tired to drive to the other coast where he lives. The yard is fenced and we do have allowable pets. The useage of the apartment had gotten more frequent and I twice deducted small amounts (agreed to by him) fromt he rent to pay for electric & water use. He came and moved everything out to another apartment he got a short distance away and stated he would be "out of our hair" now. Yesterday someone came and moved filing cabinets, desks and bookcases in, stating he was going to use the apartment as an office for a roofing company he was starting. There are also two large trailers and a truck in the yard now. Can he use the property in this manner while we are renting from him? We have not heard anything about this from him. Thanks for your help.

what does your city or countys zoning office tell you about a office located there with the zoning rules there ? Also has your LL addressed utility expenses for it ? Perhaps you might ask your LL in a letter sent registered that he /she install submeters to determine how much electricty /water /gas is used so you dont pay for utilitys you arent using (texas meter has refurbished electric meters that are very reasonable )

A key question here is....
what does your lease say your rights are as to property?? Does it include the 'small' apartment on YOUR lease??
If not, then you have no say as to its use by other residential tenants and should have considered that in your property evaluation.

Farmer is correct on the commercial use of the property though... check to see if the property is zoned for it.

As to utilities, does the 'separate' apartment have its own metering?? If not, then that could be a violation. Further, if you are paying for the utilities and the small apartment is on your bill (as you imply in your post), then simply have the 'separate' property disconnected from your meter.
