I bought a home that is 12 years old. My neighbor is now complaining that the landscaping put there was done without their concent. I know that they can not force me to remove it. I have also heard that there is something called a Permissive Easment and after an amount of time has passed that land can become mine? Is there really a thing called a Permissive Easment? If so, is there a limit to the land? (We are talking about 3 or 4 foot wide and about 100 ft long) And does anyone know what the minimum time is to claim thisland ? I live in Northern Virginia

Is the landscaping on her land? Has there been a survey of the boundary line in the last 10 years? Older surveys are often off by 3-5 feet. See if she will split the cost of a survey with you.

Since she has stated that she never gave permission for the landscaping, the time limits for a prescriptive easement began when the area was planted. There's a chance that it's been long enough that she's lost title.

Call a real estate attorney and ask about the time limits and how to sue to quiet title if it's been long enough.
