I LIVE IN CALIFORNIA AND I GAVE THE LANDLORD $420.00 DOLLARS AS A SECURITY DEPOSIT, 1 MONTH PRIOR TO SIGNING A RENTAL AGREEMENT. AT THE TIME WE WERE SUPOSED TO MEET AND SIGN THE AGREEMENT WE DECIDED NOT TO TAKE THE APARTMENT WE HAD PLANNED ON MOVING IN ON THE 8TH OF THE MONTH AND THE LANLORD DEDUCTED 11 DAYS RENT AND A 2.50 HANDLING FEE FROM THE DEPOSIT. WE NEVER MOVED IN AND NEVER SIGNED A RENTAL AGREEMENT. THE LANDLORD ALSO WANTED A FIRST AND LAST MONTHS RENT CAN THEY DO THAT?????

WELL LOOK AT IT THIS WAY:

Did the landlord LOSE any money on YOU?

What about the 8 days before you signed the lease was the place empty? and he had to re rent it so there is another 3 days and his costs to re rent.

So unless you can be very very specific on a day to day basis Like the other tenant moved out on the 7th....then yes the charges are fair.

The Landlord is entitled BY LAW not to lose any money on you!
