I used to live in New Mexico and was married and divorced while living there. My ex-husband still lives there. During our marriage we accumulated several debts, most of which I am the primary on because he did not have good credit and mine was perfect. When we divorced we split the bills in a way that was fair to both of us. Everything was spelled out in the divorce decree as to who is responsible for which account and stating that we would each "assume as his/her sole and seperate indebtedness and hold the other harmless from collection theron the following debts..." Several of the bills he took charge of we under my name only but he kept the items(big screen tv, computer). Our divorce has been final for over three years and he is not paying the bills in a timely matter, he has ruined my perfect credit with payments 30,60,90 days late. I have worked very hard to almost wipe out the debts I was responible for but he is not holding up his end of the agreement. What can I do legally to make sure he pays, to get my name off the debts, fix my credit? What are my choices? Who do I need to talk to? I have my credit reports and have requested information from the creditors as to the history of the accounts.
Thank You.
