What is the name of your state? North Carolina

I have a company trying to charge me late fees on some work he did on one of my trucks. The bill is dated 12/20/04. We paid the bill on 2/1/05. The amount of the bill is $298.74. He is trying to charge me late fees in the amount of $50.78. I am needing to know the "law" on allowable late fees that can be charged on an invoice for "service" work. The bill is only 40+ days old. There is no agreement between him or I in the time frame of paying. The invoices states due within 10 days. There is nothing on the invoice stating anything about what would happen if not paid in 10 days. Could someone let me know what the "law" saids is a reasonable amount.
:)
