Late Rent Possible Eviction Question

What is the name of your state (Massachusetts )


Today is the 10th and I still have not received rent for this month tennent did call and say he would be late because he is waiting for a Workmen’s Comp check Bla Bla Bla..he was late last month also but he did call me and pay me by the 10th.


I have a few questions. How late can they be before I send them any official notice? I seem to remember reading somewhere that I can not take any action until the 15th. I think the first procedure is sending them a 14 day Notice to Quit…is this something I can just go to my local court house or do I have to go to the District land court?

I have owned rental property for a few years now and have been pretty lucky I wound up in Small Claims Court once when a tenant did some damage to my property but this is possibly my first eviction.

I do know enough not to get nasty or threatening I don’t want to waste time arguing with them or listening to there excuses, I still have a mortgage to pay. I just want to follow the correct procedure in warning them and professionally let them know that either they pay or they get out.

I have a 1 year lease with them with an automatic renewal as a tenant at will, there about 3 months into it at this time.
