What is the name of your state?Name of your state? New York. (Staten Island)

I am a legal subtenant of an apt in New York. The tenant also lives in the apartment.

I signed a written agreement with him about a year ago, specifying the terms of the contract:

The amount of rent,
When it was due (1st of the month)
30 days notice of any change in status (termination of agreement, rent increase etc.)

Around November 4th he notified me he was increasing the rent by $25 per month.

I paid the new rent amount for December.

December fourth, I gave him written notice that I was leaving by December 31st.

Technically, I am three days shy of 30 days notice.
(his notice of the rent increase was also 3 days late.)
Am I legally bound to pay him for January too? Or is there some sort of reasonable clause or precedent that would protect me from shelling out any more dough?

**A: why would you think you do not owe rent for Jan if you did not give proper written notice to terminate a m/m lease?

1 minute late = 1 day late = 3 days late. You're on the hook.

However, given what he'd need do to collect (i.e. file a lawsuit and go through the whole procedure), I'm thinking it might be in your bests interests to informally work something out between the two of you. Maybe offer 1/10 of the rent payment as a settlement?
