What is the name of your state? missouri

I was told that if the NCP was more than 10,000 behind the CP could file and have his rights terminated. When I called the PA they said since he was going to court once a month and paying now that was not possible. He did not make a payment last month he is to busy trying to pay for his DWI he only pays to keep his self out of jail. He has agreed to sign away his rights a couple of times but the judge wouldn't alow it. My question is how many payments can he miss before I can take this action?
 


a little anxious yes. He doesn't come around except foe christmas and birthdays and thats only when I hunt him down. I have made an effort to try and keep in contact with him and try to persuade him to see his son but he is always to busy with new girlfriend and partying which is fine. I know when he does finally grow up he will regret his decision. I would love for him to come around and get to know his son but I am afraid to let them be alone together which yes I know not my choice. If he does someday take me to court I will ask for the first few visits to be supervised. It wouldn't be so bad if he wasn't still drinking all the time and out getting a DWI. That makes me fear for his saftey but i'm not in any danger so to speak of him showing much interest in our child right now.
 
If he is paying, then it is unlikely that you would win a contested TPR.

Is there a step-parent in the wings willing to adopt?

Also, how is it that if you 'know' that he'll eventually grow up and regret his actions - and you currently allow him to see the child, even to the point of 'hunting him down' for birthdays and Christmas - that you ALSO want to terminate his rights?

Contact attys that offer free consultations. They will be able to give you better advice about your situation. And as CJ said, you will need a step-parent to adopt.
 
No I do not have a step parent waiting to adopt my son my mother was going to adopt my son but the judge wouldn't go for that and he does have plenty of contact with good male role models he is with my father 3-4 times a week for 8 hour days.

Yes I would like to terminate his rights and i have stopped trying to hunt him down. I want to be fair to my son and give him a chance to know his dad but dad doesn't show interest. I want to do what I can so my son knows I tried. but then again I don't want to share him but thats not a choice I get to make

I thought with that law you didn't need a step parent I guess I was wrong their.

I guess I dont know he will grow up but I sure do hope so
