What is the name of your state? VA

I am being harassed by a collection agency, who is trying to collect a debt that isn't mine. I have already mailed a cease and desist letter as well as a validation of debt letter, both CRRR. They call me endlessly at home, at work (where my employer has told them not to call again, yet they still do), and also are calling family members. They are really rude and ugly, clearly violating the FDCPA.

Can I record the phone calls without notifying them? From what I have researched, it does not appear that I need their consent, based on VA law. However, the CA is located in NY, and I am not sure if that affects anything. Any help would be appreciated.

Senior Member
VA is a one-party state, the only consent you need to tape is YOURS. NY is also a 1-party state.. so tape away. You're not going to use the recordings for criminal purposes, so its not a big problem.

File a complaint with your State Attorney General's office about the harrasment and abuse of the FDCPA. File a complaint with the FTC too.
