My wife and I were divorced in 1998 and were separated in 1991. Part of the reason was because she had an affair with a man in 1990, and I found out just after we became separated. Is there a STATUTE OF LIMITATIONS IN CALIFORNIA which prevents me from suing the male in this case for alienation of affection, emotional distress and generally contributing to our breakup?

My response:

There is no Statute of Limitations for Alienation of Affection in California because that Cause of Action is not recognized in California. The "Heartbalm" statutes have long ago been repealed.

It's time to move on with your life after so many years. If you're finding it difficult to "let go" after 10 years, you might want to consider some mental health counseling. You really shouldn't be carrying this kind of baggage around for so long.

Good luck to you.
