Lawyer dismissed VOP to press BIGGER charges in another county.

Ok, here's my question.....My ex-boyfriend had a VOP (viloation of probation) for domestic violence on me and he had a hearing in court, which I was a witness for the state. After waiting there for 1 1/2 and it was his turn to get charged, the State's attorney stated "We have bigger fish to fry in another county and we'd like to dismiss this charge of VOP!" My jaw hit the floor. He was NOT arrest nor was he scolded!! Now, two weeks later the State's attorney in the other county told me yesterday that they are not going to press charges for the "cyber-stalking," because they don't have not enough evidence. I guess what I need to find out is, should the first State attorney re-file the VOP charges and have him arrested? He is in violation of his probation and by letting him walk free tells HIM and society that you can mass email, mass call and harass and stalk someone with 150 emails in a months time with 125 phone calls as well. This all took place at my employers. I seem to be getting the run around from all involved, police, attorneys and his probation officer. What kind of legal recource do I have? I am looking for an attorney for civil action for defamation. Please help!!!

Defamation ?

Well , sometimes DA's can bring the charge back up .

Have you talked to the DA about it ? ( for VOP ) ?

Then of course the PO would have to bring it back up also .

The Judge just might say to the DA , you had you bite at the apple , and chose to drop it .

My guess is , that if you hang in there long enough , another incident will occur for a ( VOP ) , and even though it won't be because of the DV against you , you will get some satisfaction out of it .

The defamtion comes from all the lies he's been spreading to all my professional contacts when he broke into my home and stole my Blackberry. It's a BIG long drawn out mess. I have a felong theft charge, mail tampering and now he's using my ss number! I feel so helpless....

Try getting a consult with an attorney. You can get a 30 minute consult for $25 by calling the Florida Bar Lawyer Referral Service at 1-800-342-8012. An attorney will probably know what steps yoy can take to get the VOP reinstated.

Thank you for the suggestion. I have placed a call to another lawyer, but they have not returned my call. It just feels like everything is working against me, I just have to remember that I am the victim, not the criminal.
