"OVER FOUR MONTHS AGO I LISTED A HOME I NEED TO SELL BADLY WITH A REAL ESTATE AGENT. IN THE BEGINNING WE MADE AN ORAL AGRREEMENT THAT HE WOULD KEEP ME POSTED WITH REGULAR UPDATES. I HAVE ONLY SPOKEN WITH HIM ONCE IN THE LAST EIGHT WEEKS AND THATS BECAUSE I PAGED HIM FIRST. NEEDLESS TO SAY, NO BUYERS. I THINK HE IS WASTING MY TIME! DOES ANYONE KNOW HOW I MIGHT FIRE HIM BEFORE HE WASTES TWO MORE MONTHS? IF SO PLEASE E-MAIL ME at [email protected] or post message.

Did you sign a contract with him, was it verbal only? Was it exclusive? If so the terms of the contract generally apply, however, they have the responsibility to make a good faith effort to sell the house. If they can't show you that they have tried to sell it, you could send them a letter telling them that they are in material breach and that if they don't make reasonable efforts within 60 days? you will consider the contract broken and look elsewhere.
