In May 1997 I sold a house in Connecticuit that was left to me by my mother. I have not lived in that house since 1967. I signed a disclosure statement that I was "not aware" of any lead based paint. The house was inspected for an FHA mortgage by the buyers (I did not see the inspection report). I used a real estate agent and an attorney. The attorney called me Friday and says the buyers are suing me for the cost of lead paint removal. I moved to another state in 1998 and have not received any legal paperwork yet. It is true that I was not specifically aware of any lead paint but since the house was built in 1907 and all houses used lead based paint, should I have stated anything differently on the disclosure form? More importantly am I liable? If so, since I carried standard property owners insurance on the property will the insurance company represent me based on the liabilty insurance?
