Help! We bought a brand new house Feb 2000. When the one year walk through finally took place in 2001 we had a leaking roof. Roof started leaking 3 days before the builder showed up for the walk through. He did not look at the roof, as the roof was put on the house in Jan 1999 and so there is no warranty on the roof...So we are on our own...We are shocked! So the warranty on the roof expired before we lived in the house a whole year, there is no reference to any of this in our paperwork. We debated with the builder, and he agreed to send someone out to look at it. It took another month for the repair guy to come out. He came out, indicated verbally, it was a manufactures defect and he would contact the builder. Another month went by, the repair person who looked at our roof was injured and off work, no one at the company had ever heard of him coming out to our house, nor was there any paper trail. When the guy returned, they would send him back out. Two weeks later the repair guy comes back out to our house and does some repairs on our roof. Again, no paperwork, and we were not even home when he did the repairs. The guy said to call him if the roof leaked again. Twom months went by, and now it is leaking AGAIN... We called the same repair guy, who is now laid off the job. The office said they will send someone out to look at the roof for a Huge FEE. We really need our roof fixed now, and we may have some unseen water damage. We are a young couple, with two small children. This is our first house et al.. We could really use any advice. Shall we call our insurance company? Will our insurance company pay? Our funds are kinda tight with the kids et al.. Any recommendations are deeply appreciated. Thanks so much for taking the time...

Did you have any type of warranty on the house? Did the real estate people mislead you? Was the inspector negligent? Will the roofing tile or product manufacturer conrim the tiles were defective?

The homeowners insurance company will NOT pay UNLESS there was a "tearing" or some type of damage to the roofthat results from a storm or natural castastophe. A mere leak itself would not be covered.
