I had signed a rental agreement on the 30th of June and gave the landlord $270.00 earnest money that will be considered part of the security deposit once I begin occupancy. The apt. is empty right now because the date of my occupancy isn't untill the 15th of July. My fiance that is going to be living with me does not want to rent this apartment and hasn't yet read, agreed to or signed the lease. Is there any way that I can get out of this rental agreement since the move-in date isn't for another 2 weeks. I am willing to forfeit the money I had already paid, I just don't want to be stuck in this agreement to rent this apartment seeing as how I wouldn't be able to cover the costs of the apartment on my own with my salary. Could you please give me some advice?

Sorry, your significant other is not bound but you are since you gave a partial security deposit and more importantly you executed the rental agreement. The fact that your fiance has not read, agreed to or signed the lease and that the move in date is for another 2 weeks is irrelevant.

You have 2 choices here:
1) you both live in the place like you planned to.
2) talk to your landlord and negotiate to cancel. You may want to offer to pay for the rental ad in the newspaper and show the place to prospective tenants.
I hope the rental market is hot and the place will rent out fast. If not, you will be responsible for the rent until such time that the property is rented out.
