WV: My lease states that rent is due on the 8th of every month. However, I ususally pay on the 12th. When I paid the rent today, landlord said it must be paid on the 8th or before. I didn't move in until the 8th. on the side of the agreement in writing it states "after 5 (five) days late notice is given to move the 5 days included in the 30 days notice. Rent must be paid for this 30 days" my question is. "Does this mean that I have a five day grace period after the 8th and that rent is to be paid by the 13th." Do I have until the 13th to pay the rent before the landlord can start an eviction process." Please help me understand this and what I need to do.

Normally, there is a grace period of 3 to 5 days to pay rent, depending on the lease agreement. Your best bet is to clarify this with your landlord, since the description is not too clear from what I could interpret.

WV: My lease states, and I quote,"The term of this lease shall be for one (1) year, commencing on the 8th day of Dec. 2000 and ending on the ____ day of _____, 19__" ".When 30 days notice is give"--(which is hand Written).

It does not state anything about a grace period. The one other thing that is handwritten on the lease is about the 5 five thing I mentioned previously

Payments are to be maid on the 8th day of each month. No grace period is mentioned. The only other thing that is handwritten is "after 5 (five) days late notice is given to move. the five days included in the 30 days notice. Rent must be paid for this 30 days." Does this mean I have a five day grace period after the 8th. cdm

I would say it is BADLY written, but it would hold up in court that the landlord has given you a 5 day grace period It MUST be paid by the 13th.....NO EXCUSES, or he can start eviction proceedings IN COURT!

AND if and when you vacate the apartment YOU MUST notify him with your 30 day notice BY THE 8TH.......

IF you do it after the 8th you are liable for that months rent AND the next months rent (you automatically lose your security)... NO KIDDING!
