What is the name of your state (only U.S. law)? Texas

I rented a home from from Landlord, and had nothing but issues it states in my lease for repairs I am responsible for first $100.00 of a repair, no problem.

I have a inground pool at this home, and the pool pump went out, landlord didnt want to repair so I had it fixed paid $450.00 for it, and now seeking money from him, he said I didnt give him 48 hours to respond to what he was going to do, nowhere in my lease does it say anything about this 48 hour stuff.

Then a plumbing issue came up with a root in ground going thru a pipe so basically clogged everything up, he paid to get it un clogged and everything game me the bill to pay my $100.00 portion, I told him I am not paying as he techically owes me from the pool. Thing with the plumbing is the plumber said its not fixed b/c the pipe still needs repair but my cheap landlord said everything will be fine, and it doesnt need any work. My realtor is getting me my options to get out of my lease but didnt know if anywhere here at an idea.

So, you just fixed it without notifying LL beforehand, and you gave him 0 time to fix it himself?

then you fixed it, your cost.


I dont see anything that would warrant a legal ejection to the lease.

I would not pay for the plumming anymore, because it was supposed to be fixed with your first 100.00

I'm sure that would land you in eviction court. then you can get out of the lease (because you were evicted) or it will get you money back. win win.

This posting is confusing. You first write that the landlord didn't want to repair it at all, then you state that he wasn't given 48 hours to respond to the repair request.

What really took place?

I called landlord about the pool, he said no b/c he thinks my old pool guy broke it on purpose but nobody has any proof so he thinks I need to pay it all I said no. So he said he wasnt paying for it, so in the meantime I said whatever dude and paid for it to get fixed, b/c in lease I am suspose to maintain pool maintence but cannot without a pump. So after I paid to get it fixed and told him 2 days later it was done, and I was seeking money he said I didnt give him 48 hours to decide what he was going to do even though from the get-go he said he wasnt going to pay.

So now the plumbing issue I said I wasnt paying.

Typically you can get out of leases correct even if you pay, I dont see this in my lease so does this mean it doesn't exist?

I have yet to deduct anything, I want to make sure whatever I do I am in the right not the wrong. So at this point what should/can I even do?

You can't rent deduct since you did not follow the procedure in our state.

You can send a demand letter to the landlord, he can refuse to pay.

You could take him to small claims court and hope the judge sides with you, but could likely rule against you since you gave very little time for the landlord to complete the repair.
