I recently filed chapter 7 and listed my landord on the petition. I now have to move because I cannot afford the high rent. I intend to break the lease 3 months before it expires. I live in the state of New York. Being that I filed chapter 7 and listed him in my petition am I safe from a lawsuit on his part?
Also I live in a 2 family house and the landlord uses the basement as his office/apartment and I pay for his utilities. The house only has two meters and my meter reads off for my apartment and his office/apartment in the basement. Isn't it illegal for him to use the basement as a third apartment and make me pay for the utilities?
Please help.

Well yes it is illegal for him to make you pay for his utilites, but it would usually NOT be considered an Illegal apartment, if he owner uses it, unless he lives there full time,

And you are right 2 meters makes the 3rd basment Illegal, but YOU are not in the illegal apartment, THAT MAKES A BIG DIFFERENCE in NEW YORK .......If you were living in the illegal apartment he would have to EJECT you in Supreme court NOT housing court...and that is very very expensive.

Has he offered to pay some of your electric bill?

You may be safe from owing him money but i am suprised he hasnt tried to evict you yet.....you see he could get the bankruptcy court to allow the evcition to continue, and get you out asap, the landlord has a legal right to stop running up the bill you owe him.

You can do what ever you think is best but I wouldn't take advice fro some one thatgets her kick by tring to belittle other people and their problems. She replyed to my question with contempt and hateful disreguard for my feelings or problem. she offered no advice only hate and bitchyness
