I have lived in the same rent stabilized apt. in NYC for 7.5 yrs. On 10/1/00 I signed a 2 yr renewal lease for my apt. On 1/9/01 I acquired a house in NJ that I am moving into. Also on 1/9/01 I sent my landlord a certified letter stating that I will move out no later than 1/31/01 and that I knew of 3 individuals who either wanted the lease assigned to them or were willing to renegotiate the lease w/a higher rent and would take possession of the apt on 2/1/01. On 1/11/01 I sent a follow up letter and provided the contact information of one individual who was very interested in taking the apt. Two of these individuals also called the landlord and expressed their interest in the apt. On 1/17/01 I left 2 voicemail messages w/employees of the landlord. The landlord has not responded to any of my letters or voicemails. With these facts in mind my questions are thus: What are the chances of getting back my security deposit since I have provided the landlord with 3 reputable individuals who are willing to either have the lease assigned to them or renegotiate the lease for 2/1/01? How do I go about getting a release from the lease if the landlord will not respond to me? I thank you in advance for any assistance that yo may provide.

....Man you just screwed youself out of some money.....

You probably could have hustled the landlord into paying you cash to move, if you never told him about the place in NJ...could have said to the landlord... i just dont have enough for a down payment, so i guess ill have to stay here for a couple of years more

Also why would the landlord rent to your friends anyway all he can get is 24% more rent, he can rennovate the apartment and maybe get 50% to 100% more.

The only other way is to find him and do this face to face.

did someone sign for that certified letter, and you have the reciept...then consider it delivered.

And of course you are entitled to the security back, but take lots of pictures of the apartment before you leave , cause he aint gonna give it back easily.
