On January 1 I moved into an apartment in a complex owned and managed by a large company. This was not a spur of the moment move it was long planned and much preperation made. It was a big move for me and very expensive. The prop manager and staff discussed with me in great lenghts about my need for peace and quiet they assured me this would not be a problem. I waited extra time to get an upstairs apartment,all brochures advertise quiet country living ect ect.First day in ,I hear a lagrge gathering downstairs and notice a large amount of teens comming out of an apartment second day more teens more noise. we pull an all night party I call the cops they hide everyone Ilook like a big idiot. third day I tell prop manager I want out in fact I am so upset I cry. She calms me assures me she will take care of matter ,stupid me i don,t yet realize she rented to three eighteen year old kids same day i moved in.More noise more trips to office stolen door mats missing newspapers sleepless nights.my stomache is worse than ever .finaley i start putting the preasure on our local pd and one kid is arrested for possesion and ab on police officer. still takes her a week to get kid out .the other two stay we make friendly enimies. All is quiet for two weeks until new roomate, here we go again. paties no parking loud nasty kids ,doors slamming constantly. Property manager refuses to let me out of my lease says she will take care of it ,but noise agravation continue. Even if i could get out of my lease I don,t think I could afford to move.The son of ---- have all my money and I bought new furinture first time in twenty years. I moved here believing I would be living with other working people not a bunch of partying kids,there is so much more that I have been through here I feel as if I have been here for years instead of months.HELP!!!!!

Check your state landlord tenant act about suing your landlord to enforce your lease. You can get an eviction kit from the stationary store or process server company.

In general, you provide the landlord written notice to make the neighbors cease and desist. If she doesn't, you file a suit to enforce the lease, and pay your rent to the court to hold in escrow until the case is decided. It's amazing how quickly landlords deal with problems when you LEGALLY withhold rent....

Suggest she make the kids move to another apt far away from you. She promised you quiet and was quite emphatic about her ability to deliver it. Make her do so. Tell her that if she doesn't, you will sue to break the lease and sue her for all your moving expenses and mental distress.
