We recently moved out of a house in VA & the landlord says we have to pay for filling the oil tank (over $700!). He says he'll take us to court if we don't reimburse him.
a. The closest mention of anything to this effect in the lease we signed says that we "agree to maintain heat so as to prevent freezing of plumbing, etc." this is in the event of an extended absence while we were still tenants.
b. The lease we signed expired in April '99 and we had an oral month-to-month agreement with no mention of the oil heat.
c. I orally agreed to pay for the oil only because the landlord told me that it was in our lease that I was legally obligated to do so.
d. Technically, we did not give 30 days notice upon moving out, but we told the landlord as soon as we had confirmation of the move. We also told him that we would do whatever he wished as far as the rent for the final month. At this time there was no mention of the oil.
e. The oil did run out while we were in the midst of finishing the move. The landlord put $200.00 worth back into the tank at this time which we reimbursed him for. He now wants an additional $500.00 for the remainder of the oil.
f. Out of 20 months we were more than 5 days late with our rent approximately 2-3 times.
