I live in NJ and my lease expires February 28th. To this day I have still not received my new lease to sign/reject. I am not planning on renewing the lease, but I have not told them yet.
Is there a law stating how much time they must give the tenant to review his/her lease?
Is there a law stating that the tenant MUST be served with either a lease agreement or a notice to vacate?
Is there a way I can use my security deposit for the last months rent, because of this?

Usually its 30 days, so if you pay the rent and he doesnt give you a new lease or a notice to vacate, then you become a month to month tenant, as of March 1st..

Now if YOU just want to leave you can, you dont have to give notice you can just let the lease expire.

But the landlord will not give you back your security,they have to try and get even with you somehow...so you will have to sue him in small claims court and win.

And NO you cannot use your security as the last months rent, without the landlords appproval.

So its best to tell him now so he can advertie the apartment, and for you to help him re rent it for March 1st,by showing it to prospective tenants, then he will have no choice but to give you back your security.
