Lease Not Renewed/ Month-to -month is implied

What is the name of your state (only U.S. law)? New York

I have a tenant and we had a one (1) year lease which I didn't renew for several reasons. The question I am posing is, since by new york state laws a month-to month term is implied, do the other provisions of that expired lease still remain in full force? If so, I can therefore, legally enforce them.

There has been several violations of that lease after the full year expired. I think the rational of that tenant is he/she can do anything he/she wants and does not have to account for it.

The old lease remains in effect except it has now converted to a MTM. Evict

You are too vague. What provisions are you talking about? what is tenant doing? (besides whatever she wants, because mostly, in our homes we can do whatever we want- within the law-)

So, if you don't like her, evict her in the 30 day period,and in accordance of the eviction process of NY
that is if you are not in the city, which i assume you are not, since NYCers would have said NYC.

If it is rent controlled city apartment, obviously there are different rules.

P.S. The apt is in NYC and it is not rent controlled .

Yes Indeed! Thanks. I already drafted a rent Increase Letter. The latter option can be costly for NYC favors Tenants. They can milk the system for a long time.
